Thank you for choosing All Aboard Trains 2. Please carefully review the following Terms and Conditions, which govern your use of our services.
1. Acceptance of Terms
By booking, renting, or participating in services provided by All Aboard Trains 2 ("we," "us," or "our"), you agree to be legally bound by the terms outlined in this policy.
Booking, Deposit & Payment Policy
Reservation Request: All event date requests must be submitted through our website, phone, or email. Please note: a requested date is not confirmed until the deposit is received.
Deposit Requirement: A $100 non-refundable deposit is required within 24 hours of the initial contact to secure your requested event date.
Provisional Notice: After your booking request, you will receive a message (via text and email) explaining that the date is not yet confirmed. If the deposit is not received within 24 hours, the request will expire and the date may be released and made available to other clients.
Reminders:
An initial reminder will be sent shortly after the request if no deposit is paid.
A final reminder will be sent at the 23-hour mark before the request expires.
Confirmation: Your event date is only confirmed once the deposit has been successfully received and acknowledged.
Balance Due: The remaining balance must be paid at least 24 hours prior to the event. Failure to complete payment may result in cancellation of the booking and forfeiture of the deposit.
Cancellations: Cancellations made 48 hours or more before the event may be eligible for a refund of the remaining balance (excluding deposit).
3. Use of Service
Supervision: Adult supervision is required at all times during train operation.
Safety: All riders must follow safety instructions from All Aboard Trains 2 staff. Overcrowding or unsafe behavior may result in early termination without refund.
Location: The train is designed to operate on flat, hard surfaces. Prior approval is required for use on public streets or private properties.
Client Responsibilities: The client must ensure a suitable, accessible location, provide all necessary permissions/permits, and monitor guests for compliance with safety rules.
4. Assumption of Risk
By participating in or permitting participation in an event, you acknowledge that there are inherent risks associated with mobile amusement rides. You voluntarily assume all risks of injury or property damage and agree that All Aboard Trains 2 is not liable for injuries unless caused by gross negligence.
5. Indemnification
You agree to indemnify and hold harmless All Aboard Trains 2, its owners, staff, and affiliates from any claims, damages, legal fees, or losses resulting from your use or misuse of the service, violations of these terms, or negligence by you or your guests.
6. Weather Policy
We reserve the right to cancel or reschedule services due to hazardous weather conditions, including rain, wind, or lightning, to protect our equipment and your safety.
If canceled due to weather, we will reschedule at no additional cost.
Refunds will not be issued due to weather-related cancellations.
7. Early Termination & Misconduct
All Aboard Trains 2 reserves the right to end service early without refund if:
* Guests behave inappropriately
*There is any violation of safety rules
*There is damage to equipment due to negligence
8. Dispute Resolution
Any disputes arising from these terms must first be addressed through informal negotiations. If unresolved, disputes will be settled through binding arbitration in Tulare County, California. Both parties waive the right to a jury trial or class action lawsuit.
9. No Guarantees
All Aboard Trains 2 makes no guarantees beyond those explicitly stated in writing. We do not guarantee event outcomes, guest satisfaction, or weather conditions.
10. Privacy
All customer information is handled in accordance with our Privacy Policy, available upon request. We do not sell or share your data.
11. SMS and Email Communications
By booking, you consent to receive SMS and email messages from All Aboard Trains 2, including appointment confirmations, promotional messages, updates, and offers.
Message frequency may vary. Message and data rates may apply.
To cancel SMS notifications, reply "STOP" at any time. You will receive a confirmation of unsubscribe.
To rejoin, simply opt-in again.

Carriers are not responsible for delayed or undelivered messages.
12. Media Release
By booking or attending an event, you grant All Aboard Trains 2 permission to photograph and record the train and event for marketing purposes (website, social media, flyers, etc.).
If you do not wish to have your event photographed or recorded, please notify us in writing before the event or in person.
13. Amendments
We reserve the right to modify these Terms and Conditions at any time. Updates will be posted on our website and effective immediately upon posting.
14. Governing Law
These Terms and Conditions shall be governed by the laws of Tulare County, California.
